The terms “MTN MOTOWORKS,” “we,” “us,” and “our” refer to MTN MOTOWORKS.
MTN MOTOWORKS operates this website and online store, including the information, content, products, features, tools, and services made available through it, to provide customers with aftermarket e-moto products, accessories, performance parts, lighting, controls, electrical components, rider-related products, and other related merchandise.
By visiting, accessing, browsing, purchasing from, creating an account with, or otherwise using our website or services, you agree to be bound by these Terms of Service and all policies incorporated into them by reference, including our:

SECTION 3 — INSTALLATION, PERFORMANCE & PRODUCT USE
Many MTN MOTOWORKS products require proper mechanical or electrical installation.
Professional installation is recommended for products including, but not limited to:
- Controllers
- Batteries
- Wiring
- Lighting
- Horn systems
- Electrical accessories
- Performance components
- Controls
- Braking components
- Suspension-related components
- Wheels
- Other installation-sensitive products
Customers are responsible for ensuring that products are installed, configured, programmed, wired, maintained, and used properly.
To the fullest extent permitted by applicable law, MTN MOTOWORKS is not responsible for damage, malfunction, incompatibility, or other loss caused by:
- Improper installation
- Incorrect wiring
- Incorrect voltage
- Reverse polarity
- Improper programming
- Modification
- Unauthorized repair
- Misuse
- Abuse
- Water exposure
- Impact damage
- Incompatible components
- Failure to follow product instructions
- Failure to verify compatibility
- Improper maintenance
Products designed or marketed for performance applications may alter vehicle behavior, handling, power delivery, electrical load, braking, acceleration, range, or other operating characteristics.
Customers are responsible for operating their vehicle safely and lawfully and understanding the effects of aftermarket modifications.
SECTION 4 — ELECTRICAL COMPONENTS
Electrical components require additional care because connection, installation, testing, programming, or energizing can permanently alter the product.
Electrical components include, but are not limited to:
- Batteries
- Controllers
- Wiring harnesses
- Chargers
- Displays
- Lights
- Headlights
- Rock lights
- Horn kits
- Switches
- Sensors
- Connectors
- DC/DC converters
- Electronic modules
- Powered accessories
- Plug-in accessories
Unless confirmed defective or otherwise covered by an applicable warranty, electrical components may become final sale once opened, installed, connected, energized, programmed, modified, tested, or used, as further described in our Returns, Refunds & Cancellations Policy.
MTN MOTOWORKS is not responsible for electrical damage caused by:
- Improper wiring
- Incorrect voltage
- Reverse polarity
- Incorrect configuration
- Improper programming
- Incompatible electrical systems
- Incompatible components
- Water exposure
- Modification
- Unauthorized repair
- Improper installation
- Misuse
- Failure to verify compatibility
Customers should inspect electrical products before installation.
Do not install, connect, energize, program, modify, disassemble, or continue using an electrical product that appears damaged or defective unless instructed by MTN MOTOWORKS.
SECTION 5 — ORDERS & ORDER ACCEPTANCE
Placing an order constitutes an offer to purchase the selected products under these Terms and any applicable product-specific terms.
An order confirmation confirms that we received your order. It does not necessarily constitute final acceptance of that order.
MTN MOTOWORKS may refuse, limit, place on hold, modify with customer agreement, or cancel an order where reasonably necessary because of:
- Inventory availability
- Supplier availability
- Fulfillment limitations
- Product discontinuation
- Pricing errors
- Listing errors
- Payment problems
- Suspected fraud
- Security concerns
- Invalid shipping information
- Invalid or unreachable contact information
- Regulatory restrictions
- Shipping restrictions
- Other legitimate operational issues
If MTN MOTOWORKS cancels an order that has already been paid because we cannot fulfill it, the applicable amount will be refunded in accordance with our policies and applicable law.
SECTION 6 — ORDER CHANGES & CANCELLATIONS
Customers who need to request a change or cancellation should contact MTN MOTOWORKS immediately after placing the order.
Cancellation requests should generally be submitted within 1 hour of purchase.
The one-hour period provides an opportunity to request cancellation but does not guarantee cancellation, because processing, procurement, supplier fulfillment, or other fulfillment activity may begin immediately after an order is submitted.
A cancellation request is not effective unless MTN MOTOWORKS confirms that it has been approved.
Once an order has entered:
- Processing
- Procurement
- Production
- Customization
- Supplier fulfillment
- Warehouse fulfillment
- Packaging
- Freight preparation
- Shipping preparation
- Carrier processing
- Other committed fulfillment activity
the order may no longer be eligible for cancellation.
Orders that have been marked fulfilled or shipped cannot be canceled.
If the customer no longer wants an order after fulfillment or shipment, the customer must receive the shipment and, if eligible, follow the authorized return process described in our Returns, Refunds & Cancellations Policy.
Refusing delivery does not constitute an approved cancellation.
SECTION 7 — SPECIAL ORDERS, PREORDERS & SUPPLIER-PROCURED PRODUCTS
Special-order, preorder, custom, customized, made-to-order, and supplier-procured products may involve:
- Supplier commitments
- Manufacturing commitments
- Reserved inventory
- Production expenses
- Procurement costs
- Freight expenses
- Non-refundable deposits
- Other customer-specific costs
Once procurement, manufacturing, customization, supplier fulfillment, or another non-cancellable commitment has begun, the order may become non-cancellable or non-refundable, except where otherwise required by applicable law.
Product-specific cancellation or return restrictions may also be disclosed on the applicable product page.
SECTION 8 — PRICES, DISCOUNTS, PAYMENT & BILLING
Prices, discounts, promotions, shipping rates, and availability may change without prior notice.
Unless expressly stated otherwise, listed prices do not include applicable:
- Sales tax
- Shipping charges
- Freight charges
- Customs duties
- Import taxes
- Brokerage charges
- Tariffs
- Other government, carrier, or transaction-related charges
You agree to provide valid payment information and authorize MTN MOTOWORKS and its authorized payment processors to charge your selected payment method for the amounts presented at checkout.
Discounts and promotions may be subject to:
- Expiration dates
- Quantity limits
- Customer limits
- Minimum purchases
- Product exclusions
- Geographic restrictions
- Other eligibility requirements
Discount codes may not be combined unless expressly permitted.
MTN MOTOWORKS may cancel, correct, refuse, or revoke promotions, discounts, or orders affected by:
- Technical errors
- Pricing errors
- Promotion configuration errors
- Fraud
- Abuse
- Unauthorized use
- Circumvention of promotional restrictions
where permitted by applicable law.
SECTION 9 — SHIPPING & DELIVERY
Shipping is governed by our Shipping Policy.
Orders are generally processed according to the timeframe stated in the Shipping Policy or applicable product page.
Processing time and shipping/transit time are separate.
Products may ship from:
- MTN MOTOWORKS inventory
- An authorized fulfillment warehouse
- An approved supplier
- A distribution facility
- Another authorized fulfillment location
Orders may arrive in more than one shipment.
Shipping and delivery dates are estimates unless expressly guaranteed in writing.
Carrier or logistics delays do not automatically create a right to cancel an order once the order has entered processing, committed fulfillment, or shipment.
Customers are responsible for providing accurate:
- Shipping information
- Contact information
- Email information
- Valid and reachable phone number
MTN MOTOWORKS may be unable to change shipping information after fulfillment has begun.
Incorrect, incomplete, invalid, or outdated customer-provided information may result in:
- Delivery delays
- Address correction fees
- Carrier interception charges
- Redelivery charges
- Storage fees
- Returned shipments
- Return freight
- Reshipping charges
where applicable.
SECTION 10 — TRACKING, DELIVERY & RISK OF LOSS
Tracking information may be generated before a carrier completes its first physical acceptance scan.
Temporary gaps in tracking information do not necessarily mean a shipment has been lost.
If a package appears lost or significantly delayed, MTN MOTOWORKS may assist with available carrier inquiries or claims when appropriate.
Risk of loss, title, and responsibility for shipped goods will be determined in accordance with applicable law and the applicable shipping arrangement.
Nothing in these Terms is intended to transfer risk to a consumer earlier than permitted by applicable law.
When carrier tracking confirms delivery to the address supplied by the customer, MTN MOTOWORKS is generally not responsible for theft, loss, or disappearance occurring after confirmed delivery, except where applicable law provides otherwise or evidence indicates a carrier or fulfillment error.
Customers should promptly report legitimate delivery problems so available carrier information can be reviewed.
SECTION 11 — REFUSED, UNCLAIMED & UNDELIVERABLE SHIPMENTS
Refusing delivery does not constitute an approved cancellation.
Orders that are:
- Refused
- Unclaimed
- Returned to sender
- Undeliverable because of incorrect customer-provided information
- Returned after unsuccessful delivery attempts
- Returned because the carrier could not reach the customer
- Redirected back to the sender at the customer's request
may be treated as customer-initiated returns.
Where permitted by applicable law and consistent with our Returns, Refunds & Cancellations Policy, an eligible refund may be reduced by applicable:
- Original shipping charges
- Return shipping charges
- Freight charges
- Carrier fees
- Address correction fees
- Storage charges
- Redelivery fees
- Applicable 15% restocking fee
- Reasonable condition-related or repackaging deductions
The product must first be received and inspected before refund eligibility is determined.
SECTION 12 — RETURNS, RESTOCKING & REFUNDS
Returns and refunds are governed by our Returns, Refunds & Cancellations Policy.
All returns require prior authorization.
Products returned without prior authorization may be refused.
Approval of a return request does not guarantee a refund.
Returned products must first be:
- Received
- Inspected
- Approved
before a refund is issued.
Eligible customer-initiated returns may be subject to an applicable 15% restocking fee.
Additional reasonable condition-related deductions may apply where a returned product requires extraordinary:
- Repackaging
- Replacement packaging
- Cleaning
- Reconditioning
- Replacement of missing components
- Additional handling
- Restoration
because of the condition in which the product was returned.
Original shipping, freight, expedited delivery, and other non-refundable carrier charges generally are not refunded unless the return resulted from an error by MTN MOTOWORKS or applicable law requires otherwise.
Installed, used, modified, damaged, incomplete, or otherwise ineligible products may be refused or receive a reduced refund where permitted.
SECTION 13 — INSTALLATION, LABOR & THIRD-PARTY COSTS
Unless expressly agreed to by MTN MOTOWORKS in writing or required by applicable law, MTN MOTOWORKS is not responsible for:
- Installation labor
- Removal costs
- Reinstallation costs
- Diagnostic costs
- Programming costs
- Towing
- Transportation
- Vehicle downtime
- Third-party repair expenses
- Modification expenses
- Other incidental expenses related to installation or removal
Customers should verify product condition, specifications, fitment, compatibility, and electrical requirements before installation and before incurring third-party labor expenses.
SECTION 14 — WARRANTIES
Some products may include a manufacturer warranty.
Manufacturer warranties, where applicable, are subject to the terms, exclusions, procedures, duration, and limitations established by the applicable manufacturer.
A warranty claim is separate from a standard return.
MTN MOTOWORKS may request photographs, videos, serial numbers, installation information, configuration information, troubleshooting information, or other documentation reasonably necessary to evaluate or facilitate a warranty claim.
Unless MTN MOTOWORKS expressly provides its own written warranty for a particular product, nothing on the website should be interpreted as creating a warranty beyond applicable manufacturer warranties or warranties that cannot legally be disclaimed.
SECTION 15 — INTELLECTUAL PROPERTY
All original MTN MOTOWORKS website content, including applicable:
- Logos
- Branding
- Graphics
- Product photography
- Original product descriptions
- Promotional materials
- Videos
- Text
- Designs
- Layouts
- Artwork
- Slogans
- Advertising creative
is owned by MTN MOTOWORKS or used under appropriate license or authorization.
You may not copy, reproduce, modify, distribute, publish, display, commercially exploit, sell, resell, scrape, or create derivative works from protected MTN MOTOWORKS content without prior written authorization.
Unauthorized use may violate copyright, trademark, trade dress, unfair competition, or other applicable laws.

MTN MOTOWORKS uses Shopify's ecommerce platform to operate portions of our online store.
Purchases made from MTN MOTOWORKS are transactions between the customer and MTN MOTOWORKS, except where another party is expressly identified as the seller or service provider.
Shopify provides ecommerce technology and related services but is not responsible for MTN MOTOWORKS product selection, product descriptions, customer support, fulfillment obligations, return decisions, or other merchant-controlled matters.
Customer information may be processed by Shopify and other providers as described in our Privacy Policy.

The collection, use, disclosure, and processing of personal information through the website or online store are governed by our Privacy Policy.

Customers should contact support@mtnmotoworks.com promptly if they believe there is a legitimate billing, fulfillment, return, or product issue.
MTN MOTOWORKS reserves the right to provide payment processors, financial institutions, marketplaces, insurers, carriers, law-enforcement authorities, or other authorized parties with relevant records when responding to:
- Payment disputes
- Fraud investigations
- Chargebacks
- Delivery claims
- Return disputes
- Other legitimate investigations
Such records may include:
- Order confirmations
- Policy acceptance information
- Transaction records
- Customer communications
- Shipping records
- Tracking
- Delivery confirmation
- Return documentation

Knowingly filing a false or fraudulent payment dispute does not eliminate payment obligations that are otherwise legally valid.
Nothing in this section limits a customer's lawful rights under applicable payment or consumer-protection laws.
SECTION 25 — TERMINATION & RESTRICTION OF SERVICE
MTN MOTOWORKS may suspend or terminate website access, accounts, or purchasing privileges where reasonably necessary because of:

- Repeated policy abuse

Termination does not limit other lawful rights or remedies available to either party.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
To the fullest extent permitted by applicable law, MTN MOTOWORKS' aggregate liability arising from a particular product transaction will not exceed the amount paid to MTN MOTOWORKS for the product giving rise to the claim.
This limitation does not apply where applicable law prohibits such a limitation.
SECTION 29 — INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless MTN MOTOWORKS and its owners, employees, contractors, affiliates, suppliers, and service providers from third-party claims, liabilities, losses, or reasonable costs arising directly from:
- Your material violation of these Terms
- Your unlawful use of our services
- Your infringement of a third party's rights
- Fraudulent activity
- Unauthorized commercial use of MTN MOTOWORKS intellectual property
- Your misuse or unauthorized modification of a product where the claim arises from that misuse or modification
This provision does not require a consumer to indemnify MTN MOTOWORKS for claims resulting solely from MTN MOTOWORKS' own unlawful conduct where such indemnification is prohibited.
SECTION 30 — CONSUMER RIGHTS
Certain jurisdictions provide consumers with statutory rights concerning:
